HQCELL TERMS OF SERVICE
Terms for using HQcell.
These terms describe the rules for using HQcell’s tour, charter, and rental operations software. Effective August 20, 2026.
Acceptance and account authority
By creating an account, using HQcell, or using an HQcell-powered customer booking flow, you agree to these terms. A person creating or administering a business account represents that they are authorized to act for that business and will keep account credentials confidential. Account access may be limited, suspended, or removed when needed to protect the service, prevent misuse, or enforce these terms.
The service
HQcell provides configurable booking and operations software for tour, charter, and rental businesses. Features can include scheduling, availability, guest records, waivers, asset allocations, operational tasks, payment workflows, weather information, and message preparation. Features that depend on a third-party provider, account configuration, or user-entered operating rule are available only when that configuration is complete.
Business operator responsibilities
Each operator is responsible for the accuracy of its services, schedules, availability, prices, asset condition, capacity rules, cancellation and refund policies, guest communications, waivers, tax treatment, permits, insurance, safety procedures, and compliance with laws that apply to its operation. HQcell supports operational workflows; it does not make safety, weather, seaworthiness, staffing, licensing, or legal-compliance decisions for the operator.
Bookings and payments
When a business enables the configured public payment flow, customers must pay the full booking amount through the available Stripe payment experience before HQcell finalizes a public reservation. The applicable operator is responsible for the underlying tour, charter, rental, goods, services, customer disclosures, cancellations, refunds, and customer support. Stripe processes payment information under its own terms. Refund, failed-payment, and dispute records may be shown in HQcell when supported by the configured payment workflow, but the operator remains responsible for its customer-facing commercial decisions and required responses.
Acceptable use
You may not use HQcell to violate law, infringe rights, upload malicious code, attempt unauthorized access, interfere with the service, collect information without authority, misrepresent your identity or business, or process information in a way that violates applicable privacy, consumer, payment, or safety requirements. You may not reverse engineer, copy, resell, or create a competing service from HQcell except to the extent a restriction is prohibited by law.
Data, privacy, and third-party services
You retain responsibility for the operational data you enter and for obtaining any required customer permissions. HQcell processes that information to provide the service as described in the Privacy Notice. Your use of Stripe, Resend, and other integrated services is also subject to their own terms and policies. Provider outages, configuration errors, or withheld provider approval can affect the availability of connected features.
Availability and changes
HQcell works to provide a reliable service but does not promise that every feature will be uninterrupted, error-free, or available in every location or operating condition. Features, interfaces, and integrations may change as the product develops. HQcell may update these terms by posting a new effective date. Continued use after the effective date means you accept the updated terms to the extent permitted by law.
Disclaimers and limits
To the maximum extent permitted by law, HQcell is provided on an “as available” basis and without warranties that are not expressly stated in these terms. HQcell is not responsible for an operator’s business decisions, weather decisions, safety decisions, guest conduct, asset condition, regulatory obligations, or the actions of third-party providers. Some jurisdictions do not allow certain limitations, so these limits apply only to the extent permitted by law.
